Civil Litigation FAQ
What is civil litigation
Civil litigation refers to the legal process of resolving non-criminal disputes between individuals, companies, or organizations through the court system. In South Africa, common civil matters include contract disputes (e.g., failure to honour lease agreements), debt collection, personal injury claims, property disputes, defamation, family-related matters such as maintenance enforcement, and administrative review matters like challenging government decisions.
Which Courts Handle Civil Cases?
The court that hears your case depends on the monetary value and nature of your claim. South Africa’s civil court hierarchy works as follows:
- District Magistrates’ Court – Claims up to R200,000
- Regional Magistrates’ Court – Claims between R200,000 and R400,000
- High Court – Claims exceeding R400,000 or complex legal matters
- Supreme Court of Appeal – Appeals from the High Court
- Constitutional Court – The apex court for constitutional matters
- Labour Court – Specialized court for employment-related disputes
What steps are involved in a civil litigation case?
The civil litigation process typically begins with an initial consultation and case assessment, where an attorney evaluates whether a valid legal claim or defence exists. Once confirmed, your attorney will draft the necessary legal documents — such as a summons, plea, or notice of motion — to initiate or defend proceedings on your behalf. Alternative dispute resolution methods such as negotiation, mediation, and conciliation may also be explored before or during court proceedings to potentially resolve the matter faster and more cost-effectively.
How Much Does Civil Litigation Cost in South Africa?
Civil litigation costs in South Africa can vary significantly depending on the complexity of the case and the court involved. For Magistrate’s Court and High Court matters, attorney fees are guided by an official tariff scale, with the latest amendments taking effect in November 2017 — though attorneys may charge higher rates if the client agrees upfront. As a general estimate, costs including summons, sheriff fees, consultations, trial preparation, and court appearances can run from tens of thousands to well over R100,000 for contested matters. The South African Law Reform Commission (SALRC) has noted that escalating legal fees remain a significant barrier to justice for many South Africans, with disputes taking an average of three to six years to resolve.
What If I Cannot Afford a Civil Litigation Attorney?
Legal Aid South Africa provides professional legal advice and representation at no cost to qualifying individuals who cannot afford private attorneys. Mediation is another accessible and cost-effective option, with mediation services available at multiple courts across Gauteng and other provinces, including Johannesburg Central, Randburg, Pretoria North, Soweto, and Sebokeng. For those who do not qualify for Legal Aid but still need assistance, many private law firms offer initial consultations, and contingency fee arrangements may also be negotiated in certain types of claims.
