Debt Collection FAQ
What Is Debt Collection?
Debt collection is the legal process of pursuing payment from individuals or businesses that have defaulted on their financial obligations. In South Africa, debt collection is governed by three key pieces of legislation:
- Debt Collectors Act 114 of 1998 (DCA) – Establishes the Council for Debt Collectors and sets conduct standards for registered debt collectors
- National Credit Act 34 of 2005 (NCA) – Promotes responsible lending and provides mechanisms for debt restructuring and consumer protection
- Magistrates’ Courts Act 32 of 1944 – Provides legal court procedures for enforcing debt recovery
All debt collectors must be registered with the Council for Debt Collectors — operating without registration is a criminal offence.
What Is the Step-by-Step Debt Collection Process?
The legal debt collection process in South Africa follows strict, regulated steps:
- Informal demand – The creditor contacts the debtor to settle voluntarily
- Section 129 Notice – A formal notice sent via registered mail informing the debtor of the default and advising them to seek debt counselling or dispute resolution
- Letter of Demand – A formal legal letter stating the amount owed and the consequences of non-payment
- Summons – A sheriff of the court serves the debtor with a court summons at their registered address; the debtor has 10 court days to respond
- Default Judgment – If the debtor fails to respond, the court grants judgment without a trial
- Enforcement – The creditor may pursue garnishee orders, attachment of assets, or section 65 proceedings to recover the debt
Can a Debt Expire in South Africa?
Yes — under the Prescription Act 68 of 1969, most debts in South Africa prescribe (expire) after 3 years from the date the debt became due. This means that if a creditor has not taken legal action or received any acknowledgement of the debt within that period, the debt can no longer be legally enforced. However, prescription is interrupted — and the 3-year clock resets — if the debtor makes even a partial payment or acknowledges the debt in writing. Mortgage bonds and security-backed loans typically enjoy a longer prescription period.
What Are a Debtor's Rights During Collection?
South African law strongly protects debtors from abusive collection practices. As a debtor, you have the right to:
- Receive a Section 129 Notice before any legal action is taken
- Defend yourself against a summons in court
- Propose a repayment plan or apply for formal debt restructuring through a registered debt counsellor
- Be protected from harassment, threats, or unlawful collection practices under the Debt Collectors Act
Debt collectors are strictly prohibited from using intimidation, making false statements, or collecting debts without a valid court judgment in enforcement situations.
What Happens If a Judgment Is Granted Against Me?
Once a valid judgment is obtained, the creditor has several legal enforcement tools available:
- Warrant of Execution – A sheriff may attach and sell your movable property (furniture, vehicles, equipment) to settle the debt
- Section 65 Proceedings – You are summoned to court to explain why you cannot pay; the court may order installment payments or an emoluments attachment order (garnishee) deducting amounts directly from your salary
- Garnishee Order – Your bank can be ordered to pay the creditor directly from your savings or investment accounts
- Sale in Execution of Immovable Property – As a last resort, and with mandatory judicial oversight, your home or land can be sold — particularly if it is your primary residence
